High Court slaps Rs 25,000 fine on Tripura University for negligence

Agartala: The Tripura High Court has imposed a fine of Rs 25,000 on Tripura University for its negligence in issuing a certificate to an assistant professor, which led to unnecessary legal proceedings.

Justice Arindam Lodh, while resolving the case on Thursday, ordered the university to remit the amount by Friday.

The court expressed disappointment that an assistant professor had to resort to legal action for a matter that should have been handled efficiently by the administration of a prestigious institution.

According to advocate Purushottam Roy Barman, his client Rajat Deb, an assistant professor of commerce at Tripura University, sought to apply for a professor’s position advertised in the previous month.

Despite repeated follow-ups, Deb received no response from the university to his requests for a no objection certificate (NOC) and an experience certificate, both essential for his application.

Roybarman said during proceedings, registrar Deepak Sharma attempted to convince the court that NOCs were unnecessary for ‘internal candidates applying for teaching and non-teaching posts’. However, the court found this explanation unsatisfactory.

“This is an utter negligence of the university and its authorities responsible for dealing with the matter. The logic and the reasoning given by the registrar are not at all acceptable. Had the NOC not been required, why did the university prefer to keep silent and why it was not informed to the petitioner,” Justice Lodh said.

“The petitioner is required to be compensated for unnecessarily dragging him into litigation. The court has also wasted its valuable time on such a negligent act of Tripura University and for which it has to pay Rs 25,000 as compensation to the petitioner by Friday,” the judgment read.
