Guwahati: The National Consumer Disputes Redressal Commission (NCDRC) has ordered Assam’s GNRC Hospitals Limited to pay Rs 20 lakh in compensation for medical negligence that caused a patient to suffer significant disability.
The landmark judgment, delivered on April 30, 2025, underscores the critical importance of accountability within the medical profession and offers hope to those affected by medical negligence.
The case was brought before the NCDRC by Takam James, a resident of Arunachal Pradesh, who filed a complaint against Dr. Navanil Barua, Dr. Bivan Bihari Dey, and Dr. Monoj Agarwal, all medical professionals at GNRC Hospital in Guwahati.
James sought substantial compensation, alleging gross medical negligence during his treatment at the hospital.
While the initial compensation claim of Rs 12,40,19,000 was deemed disproportionate by the NCDRC due to a lack of supporting evidence, the Commission meticulously reviewed the details of the case.
The judgment recognized the profound trauma and suffering endured by James, the considerable expenses he incurred for extensive treatment across various medical facilities, including the arduous journey from Arunachal Pradesh to VMC, Vellore, in Tamil Nadu for specialized care and his ongoing need for continuous medical attention and medication.
Presided over by Subhash Chandra and AVM J. Rajendra, AVSM VSM (Retd.), Member, the NCDRC acknowledged the far-reaching impact of the medical negligence on James’ life and his future well-being.
Considering the situation, the NCDRC found it appropriate to award a lumpsum compensation of Rs 20,00,000 to James.
This amount is to be paid jointly by the three defendant doctors at GNRC Hospital within one month from the date of the order.
The Commission further directed that in the event of any delay in payment, the defendants would be liable to pay a simple interest of 12% per annum for the duration of the delay until the final payment is made.
Additionally, the Opposite Parties were instructed to pay Rs 50,000 as costs to the complainant.
